CREATIVE PHOTO FORUM - LEGAL NOTICE (Terms and Conditions)

The following terms and conditions apply to all contents under the domain, with or without the prefix "www.", http://www.creative-photo-forum.com, in the following referred to as CPF. CPF is a product of CREATIVE DRAGON WORKS and is represented by H. Wiekhorst

CPF offers two features where users can post their own content. These features are:

Copyrights:

CPF respects copyrights, but will not be able to control its user. Every user is, by himself, fully responsible and liable for his uploaded content.

Every user of CPF is asked only to upload content of which he is the copyright holder. Further, every user is advised to protect his work by either using watermarks or by only uploading low resolution files or by a combination of both.

Every user, who wishes to use content being not of his own copyright has to prior contact the relevant copyright holder to obtain legal permission. However, as a rule of using CPF, it is not a breach of copyright if any content is copied for discussion purpose only into the forum.

In the event CPF receives a note of a person being shown on a picture uploaded to CPF and the contacting person objecting such, CPF will not carry any responsibility, but will refer the case to the relevant user who has posted that picture and who is fully responsible for his uploaded and posted content. CPF will not remove such content, unless the user who posted the content can not be reached within a period of 14 days.

Content Policy:

If a user wants to upload nude-art photos to the Photo Gallery, he is asked to make use of the available function of a hidden album, which then only can be seen by those to whom he supplies the albums direct link. While CPF welcomes such art, such a link is allowed to be made public only within the Premium Forum, NOT in the Open Forum.

CPF does not allow pornographic content. Uploading such will result in its removal and if repeated by a user, in banning the user from the forum. The judgement of CPF in such cases is final and non-negotiable.

Users are encouraged to report malicious content to CPF for its evaluation and, if necessary, final action.

CPF does not guarantee any minimum content and/or visiting Internet traffic.

CPF allows registered users of the Premium Forum only, to advertise with one thread only in an especially for this purpose created sub-forum. The advertising size is determined as the user designs it and can be changed and/or updated by the user at any time oduring valid membership.

CPF has at all times the right to restructure, categorize, re-organize any content and feature or to remove any content for any reason.

Membership Fee:

Membership fees are solely for providing the features as descripted in this Legal Notice, not for any minimum content. They must be paid in advance on an annual basis via the Register page of CPF.

CPF has at all time the right to change the membership fee by announcment in the Premium Forum with four weeks time in advance. Any changes of membership fees will only affect new members and membership renewals, being due after the time of notice has passed.

Registration:

There is no registration for the Open Forum

To register to the Photo Gallery, please enter the Gallery and there, in the upper right corner of the page, click on Register to follow the instructions.

Registration to the Premium Forum is equal to a subscription, in the meaning of automatic renewal and charging if not unsubscribed prior to the renewal.

Registration to the Premium Forum must be done via the CPF Register page by clicking on the Subscribe Button with the currency of your choice. This will lead first to a Pay Pal payment processing page and will require the opening of a subscription account by providing a password. The registrant is advised to carefully remember this password in case once he wishes to unsubscribe After successful payment Pay Pal automatically will open the Forum Registration Agreement which reads as follows:

Whilst we attempt to edit or remove any messages containing inappropriate, sexually orientated, abusive, hateful, slanderous, or threatening material that could be considered invasive of a persons privacy, or which otherwise violate any kind of law, it is impossible for us to review every message posted on this discussion system. For this reason you acknowledge that all messages posted on this discussion system express the views and opinions of the original message author and not necessarily the views of this bulletin board. Therefore we take no responsibility and cannot be held liable for any messages posted. We do not vouch for or warrant the accuracy and completeness of every message.

By registering on this discussion system you agree that you will not post any material which is knowingly false, inaccurate, abusive, hateful, harassing, sexually orientated, threatening or invasive of a person's privacy, or any other material which may violate any applicable laws.

Failure to comply with these rules may result in the termination of your account, account suspension, or permanent ban of access to these forums. Your IP Address is recorded with each post you make on this discussion system and is retrievable by the forum staff if need-be. You agree that we have the ability and right to remove, edit, or lock any account or message at any time should it be seen fit. You also agree that any information you enter on this discussion system is stored in a database, and that "cookies" are stored on your computer to save your login information.

Any information you provide on these forums will not be disclosed to any third party without your complete consent, although the staff cannot be held liable for any hacking attempt in which your data is compromised.

There will be no other choice than to agree or to abort, in which case the already paid membership fee will not be refunded.

When clicking on "I Agree" the registrants contact details will need to be provided.

PLEASE ENTER THE SAME E-MAIL AS BEFORE FOR THE PAYMENT !!! This will be used for cross checking the validity of membership. Any registered member account with no payment record will be deleted.

Final Note:

Anyone who registers to any of CPF's features expressively acknowledges having read this Legal Notice and confirms his unconditional agreement to the terms and conditions as mentioned in this Legal Notice.
